Report of Action Taken at the Settlement Meetings May 7 & 8, 2015 at Templin’s Red Lion
1) Tribe Claims Settlement discussions on Thursday, May 7, 2015, ended with no future meeting date established. During the meeting, prior to the lunch break, there seemed to be a willingness to negotiate by all parties involved. But there was an unexpected development about 2:00pm when Mr. Howard Funke, Attorney for the Coeur d’Alene Tribe, announced that they had filed 33 objections to claims in Basin 92. (30 of which are individual persons (not corp.’s) residing in Benewah County on Sheppard Rd or Alder Creek Rd. – per Pam Secord (North Idaho Water Rights Alliance) According to our Attorney, Norm Semanko, this was a first. The US Dept. of Justice Rep & Bureau of Indian Affairs indicated that they were not a party to these objections. It remains to be seen where this action by the Tribe will take things. The attorneys are all looking at this very seriously. We shall see where it goes from here. All Water Right Claimant’s, Objectors & Responders will be allowed in meetings as they happen. The Idaho State Legislature assured our right to be at these meeting via House Concurrent Resolution 62 passed in 2014.
2) Forest Service Settlement Discussion ended with the agreement to try & negotiate a settlement. The next meeting is scheduled for June 12, here in Coeur d’Alene, at either the Forest Service office or the Department of Environmental Quality office. The Forest Service meetings are only open to those that signed on as Objector’s or Responder’s in the Court Action for the CSRBA.
Reports from the meetings will be posted on the SRBA website (Water Court). http://csrba.idaho.gov/CSRBA1.HTM
